It is very often unclear as to whether a landlord or tenant is responsible for emptying a septic tank, if there is one at the property. Under Section 11 of the Landlord and Tenant Act 1985 the landlord is responsible for keeping in repair and proper working order, among other things, the installations for sanitation. However, if the septic tank is in good repair and working order, and was emptied at the commencement of the tenancy, it is quite reasonable to expect the tenant to ensure that it is emptied regularly, or when needed, provided the tenancy agreement makes him do so. If it does not or if the tank was not emptied at the start of the tenancy, then the landlord is responsible for emptying it.
