Hello everyone, I'm new to this site and want to say I appreciate the community of help and advice given here. Well done. I bought my first house in this country two years ago and have rented out a room to a lady for the last 18 months. Please note I also live in the house. She has been a brilliant tenant. Over the same period I have rented the second large room to a young man for three months until he returned to Holland. He was fine. Second was an American lady for a few months until she moved away. She was fine. Thinking there was a shortage of tenants, I foolishly rented out the room to a young couple who turned out to be on benefits. They have been in the house almost a month now, not paid any rent and have been thieving lots of food and personal belongings from myself but mainly my other tenant. They explained that the council delays in processing rent payment and a council lady also called me to confirm this. Despite repeated requests not to steal our food and things, they have persisted and lied by saying they did not do it despite me catching them in the act a few times! They also smoke in the house and keep a growling dog in their room despite telling me they don't smoke indoors or own the dog. These, and others, go against the rental agreement they signed when they moved in. Rent was agreed to be paid in advance at the beginning of the month and that has not happened. I had a discussion about them moving out (as I want to go back to Australia) but they got very aggressive and nasty towards me and my other tenant. We felt scared and I had the police round. Basically, I want them out of my home asap. What should I do? I was advised that I would need to go though a solicitor to get a court judgement out on them. This would take 3 months or more I reckon. The rental agreement we both signed says that either party can give 1 month notice to move out. Can this stand up legally? Thank you. |

O WHY WHY DO YOU ALLOW TENANT TO DICTATE TO YOU WHAT TO DO IN YOUR OWN PROPERTY. DO WHAT I TELL YOU AND BY THE GRACE OF GOD NOTHING WILL HAPPEN TO YOU BY ANY LAW. ASK A LOCK SMITH TO CHANGE THE MAIN ENTRANCE LOCK, AND TO THE ONE THEY LIVE IN. THEN PACK ALL THEIR THINGS IN A BLACK BAG READY. FOR WHEN THEY COME BACK. DON'T LET THEM THROUGH THE FRONT DOOR. MAKE SURE THE OTHER TENANT GET THE NEW KEYS TO THE FRONT DOOR. NOTHING ILLEGAL THAT YOU ARE DOING YOU ARE TAKING BACK WHAT BELONGS TO YOU, PLUS THE MORTGAGE NEEDS TO BE PAID SIMPLE. NOW, IF THEY CALL THE POLICE TELL THEM THEIR IS AN AGGREMENT FOR THEM TO MOVE OUT AND NOW NEW TENANTS HAVE MOVED INTO THEIR PLACE. ALSO THEY ARE VERY AGGRESIVE TOWARDS YOU AND THE OTHER TENANTS, BUT WHEN THEY TOLD YOU THEY WHERE LEAVING YOU WHERE GLAD. SO YOU DO NOT KNOW WHY THE CALL FOR THE POLICE.
