| A student tenant ran up a large debt, she failed to keep any easy payment schedule put in place. She left, I went to the small claims court. No response from her so got a judgement in default. Still nothing from her, I applied for a warrant to which she has replied she can afford £30 a month. If I agree it will take her over 3 years to pay off the debt. She might pay one or two payments the stop - what can I do next? |

We presume that as she was a student that you secured a gurantor on the letting? If so, you could cc (if you havent done so) the guarantor into the court papers. Then you could hold her and her guarantor liable. In respect to the £30per month, has this been decided by the court or something that she has offered you. As it may be the best offer you have, as the court could award a lower amount if they costed out her expenditure in/income out etc. Bearing in mind, if she is a student she also has her student loan to pay off. If you can trace her, see if she has secured herself employment. If so, you could always get an attachment of earning order. Regards pebble - effective landlord solutions www.pebbleonline.net |
